- Eligibility: What Would You Do With 48 Cores? (the “Contest”) is open only to legal residents of fifty (50) United States (including the District of Columbia) and Canada (excluding Quebec) who are at least eighteen (18) years of age as of the Entry Period (defined below) or have reached the age of majority in their jurisdiction of residence, whichever is older. Employees of Advanced Micro Devices, Inc., GLOBALFOUNDRIES Inc., and Intel Corporation, and each of their subsidiaries, affiliates, officers, directors, employees and agents, and the immediate family (defined as parents, children, siblings and husband or wife) of each such employee, together with those with whom such employees are domiciled, are not eligible to participate.
- Sponsor: The Contest is sponsored by Advanced Micro Devices, Inc., One AMD Place, PO Box 3453, Sunnyvale, CA 94088-3453 (“AMD” or “Sponsor”).
- Agreement to Official Rules: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
- Entry Period: The Contest begins on March 3, 2010, at 12:01 a.m. EDT and ends on March 24, 2010, at 11:59 p.m. EDT (the “Entry Period”). Entries that are submitted before or after the Entry Period will be disqualified.
- Video Submissions:
- Create a Video Entry: Entrants may enter the Contest by submitting an original video. To enter, you must create a video that describes in a creative way what you would do with 48 cores (your “Video Entry”). Please review the Section of these Official Rules entitled “Judging Criteria” for details on how Video Entries will be judged. Your Video Entry must meet each of the following requirements:
(i) The Video Entry must be no longer than three (3) minutes.
(ii) The Video Entry may not contain any trademarks, logos, or copyrighted elements other than elements owned by the entrant or AMD. Any content that appears in the Video Entry including, without limitation, images, music, audio, speech, or other audiovisual materials used must be entirely original, created and performed solely by the entrants, or be in the public domain. Use of any content that is not original or in the public domain may result in disqualification of the Video Entry, in the Sponsor’s sole discretion.
(iii) The Video Entry may not be obscene or indecent, it must not contain defamatory statements, it must not include threats to any person, place, business, or group, it must not invade privacy rights or any other rights of any person, business, or group, and it must not name or depict any third party without his/her permission.
(iv) The Video Entry may not depict or encourage any dangerous, life-threatening, or otherwise risky behavior.
(v) The Video Entry must comply with the YouTube Terms of Service, found at http://www.youtube.com/t/terms.
- Submit Your Video Entry: Once you have created a Video Entry that meets each of the requirements set forth in Section 5a, submit your Video Entry and valid email address through the “What Would You Do With 48 Cores?” Contest entry form at http://blogs.amd.com/work/48-cores-contest-entry-form/. Please consult www.youtube.com for all acceptable file formats.
- Essay Submissions
- Create an Essay Entry: Entrants may enter the contest by submitting an original essay. To enter, you must write an essay about what you would do with 48 cores (your “Essay Entry”). Please review the Section of these Official Rules entitled “Judging Criteria” for details on how Essay Entries will be judged. Your Essay Entry must meet each of the following requirements:
(i) The Essay Entry must be in the English language; Essay Entries in any other language will not be eligible.
(ii) The Essay Entry must contain 500 words or less; Essay Entries containing more than 500 words will not be eligible.
(iii) The Essay Entry may not contain any trademarks, logos, or copyrighted elements other than the AMD logo and elements owned by the entrant. Any content in the Essay Entry must be entirely original and created solely by the entrant, or be in the public domain. Use of any content that is not original or in the public domain may result in disqualification of the Essay Entry, in the Sponsor’s sole discretion.
(iv) The Essay Entry may not be obscene or indecent, it must not contain defamatory statements, it must not include threats to any person, place, business, or group, it must not invade privacy rights or any other rights of any person, business, or group, and it must not name or depict any third party without his/her permission.
(v) The Essay Entry may not depict or encourage any dangerous, life-threatening, or otherwise risky behavior.
- Submit Your Essay Entry: Once you have created an Essay Entry that meets each of the requirements set forth in Section 6a, submit your Essay Entry and valid email address through the “What Would You Do With 48 Cores?” Contest entry form.
- Blog Submissions:
- Create a Blog Entry: Entrants may enter the Contest by creating and publishing a blog. To enter, you must write an original blog about what you would do with 48 cores (your “Blog Entry”). Please review the Section of these Official Rules entitled “Judging Criteria” for details on how Blog Entries will be judged. Your Blog Entry must meet each of the following requirements:
(i) The Blog Entry must be in the English language; Blog Entries in any other language will not be eligible.
(ii) The Blog Entry must contain 500 words or less; Blog Entries containing more than 500 words will not be eligible.
(iii) The Blog Entry may not contain any trademarks, logos, or copyrighted elements other than the AMD logo and elements owned by the entrant. Any content in the Blog Entry must be entirely original and created solely by the entrant, or be in the public domain. Use of any content that is not original or in the public domain may result in disqualification of the Blog Entry, in the Sponsor’s sole discretion.
(iv) The Blog Entry may not be obscene or indecent, it must not contain defamatory statements, it must not include threats to any person, place, business, or group, it must not invade privacy rights or any other rights of any person, business, or group, and it must not name or depict any third party without his/her permission.
(v) The Blog Entry may not depict or encourage any dangerous, life-threatening, or otherwise risky behavior.
- Submit a Link to Your Blog Entry: Once you have created a Blog Entry that meets each of the requirements set forth in Section 7a, submit a link to your Blog Entry and valid email address through the “What Would You Do With 48 Cores?” entry form.
- Entrant’s Warranties and Representations: By submitting a Video Entry, Essay Entry, or Blog Entry, each entrant warrants and represents:
- The Video Entry, Essay Entry, or Blog Entry (i) is original to the entrant, (ii) does not infringe the intellectual property, privacy, publicity, or any other rights of any third party, (iii) does not violate any law or regulation, and (iv) has not previously been entered in any other Contest.
- To the extent the Video Entry depicts any individual or features the voice of any individual, the entrant is the individual pictured and heard in the submission, or, alternatively, that the entrant has obtained permission from each person appearing in the entry or, if that person is a minor, permission from that person’s parent or legal guardian, to grant the rights to the Sponsor described in the “Sponsor’s Rights to Entries” section below, and can make written copies of such permissions available to the Sponsor upon request.
- Sponsor’s Rights to Entries: By submitting a Video Entry, Essay Entry, or Blog Entry, each entrant:
- Irrevocably grants to the Sponsor, its agents, licensees, and assigns the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use the Video Entry, Essay Entry, or Blog Entry as-is or as-edited (with or without using the entrant’s name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from the entrant or any other party.
- Forever waives any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude the Sponsor’s use of the Video Entry, Essay Entry, or Blog Entry, or require the entrant’s permission for the Sponsor to use the Video Entry, Essay Entry, or Blog Entry.
- Agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor on the grounds that any use of the Video Entry, Essay Entry, or Blog Entry, or any derivative works, infringes any of the entrant’s rights as creator of the Video Entry, Essay Entry, or Blog Entry including, without limitation, copyrights, trademark rights, and moral rights.
- Judging Criteria: Beginning on or about March 25, 2010, and upon confirmation by Sponsor that the Video Entries, Essay Entries, and Blog Entries meet all the requirements in Sections 5a-7a, a panel of judges selected by the Sponsor will evaluate all Video Entries, Essay Entries, and Blog Entries and pick a potential winner based on the following criteria (the “Judging Criteria”): quality, creativity, originality, consistency with, and promotion of, the AMD brand, and overall impact. On or before April 15, 2010, the winner will be identified on http://blogs.amd.com/work and notified pursuant to Section 11.
- Notification and Requirements of a Potential Winner: The potential winner will be notified by email after the date of selection. Except where prohibited, the potential winner may be required to complete in its entirety, sign and return an affidavit (or declaration) of eligibility and a liability/publicity release. In addition, the potential winner may be required to sign a release in which he/she irrevocably assigns and transfers to the Sponsor any and all rights, title and interest in Video Entry, Essay Entry, or Blog Entry, including, without limitation, all copyrights and trademark rights, and waives all moral rights in the Video Entry, Essay Entry, or Blog Entry. Documents must be signed and returned to the Sponsor within ten (10) days of being notified. If the potential winner fails to sign and return the required documents within the required time period or is otherwise ineligible to receive the prize, or if the potential winner fails to provide any requested information, an alternate entrant may be selected in his/her place according to the selection procedures set forth above. The prize will be sent to the address provided by the potential winner. (The motherboard may be drop-shipped to the potential winner directly from the manufacturer.) Allow up to eight (8) weeks for delivery of the prize in its entirety.
- Prize: One (1) winner will receive one (1) TYAN S8812 motherboard and four (4) AMD Opteron™ 6174 processors (12-cores, 2.2 GHz), one copy of Windows Server® 2008 software, with an approximate total retail value of $8,189 USD.
Limit one entry per person during the Entry Period. Multiple entries from the same individual or email address during the Entry Period will not be accepted, or if accepted, will result in disqualification. Odds of winning a prize depends on the number of Video Entries, Essay Entries, and Blog Entries received during the Contest. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Sponsor may report the receipt of any prize to the appropriate federal, state, or local taxing agency(ies). Any and all guarantees and warranties are subject to the manufacturer’s or service provider’s terms and conditions, and winner agrees to look solely to such entity for any such warranty or guarantee claim.
- Privacy and Publicity: Except as set forth herein, all information submitted by entrants in the Contest will be treated according to the Sponsor’s Privacy Policy. Except where prohibited, participation in the Contest constitutes an entrant’s consent to the Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
- General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) award the prizes according to the Judging Criteria from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The Contest is subject to federal, state, provincial, and local laws and regulations and is void in Quebec and where prohibited.
- Compliance with Laws; Indemnification: By entering, entrants agree that their Video Entry, Essay Entry, or Blog Entry shall comply with any and all laws, statutes, regulations, rules, or the like applicable to the posting of photos, videos, or other media on public websites (including all rules of any Web host to which such content is posted). By entering, entrants agree to defend, indemnify and otherwise hold Sponsor and their agents, officers, directors, and employees (the “Released Parties”) harmless from and against any and all liability of any nature whatsoever arising out of or relating to (a) the content in entrant’s Video Entry, Essay Entry, or Blog Entry; (b) any technical errors that may prevent an entrant from submitting a Video Entry, Essay Entry or Blog Entry; (c) unauthorized human intervention in the Contest; (d) errors in the administration of the Contest or the processing of Video Entries, Essay Entries, or Blog Entries; (e) the receipt, transfer, use, handling, transportation, storage, hosting, posting, or display in any manner of the Video Entries, Essay Entries, or Blog Entries, (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use of any prize, including any such claim by AMD’s employees or any third parties. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. In addition, Sponsor reserves the right to report inappropriate Video Entries, Essay Entries, or Blog Entries to www.youtube.com, any applicable law enforcement authorities.
- Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Santa Clara County, California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.
- Contest Results; Posting of Official Rules: A list of winners will be posted on http://blogs.amd.com/work for four weeks following the close of the Contest.
